We are pretty sure that when we say ‘we are excited for summer’, that we aren’t alone in that sentiment. After a long and cold winter, spring is right around the corner! Spring is a time for new beginnings and a refreshed outlook on the months ahead. You may have a few spring home renovation projects in mind that you have been dreaming up over the winter months, and now you are just waiting for the snow to melt.

The recent RE/MAX Canada Renovation Investment Report found more than 50% of Canadian homeowners renovated their home in 2021. The renovation ‘craze’ is definitely not over and is being driven primarily by challenging low-supply market conditions.

So with green grass and warm temperatures within our grasp, it’s time to start thinking about your home project list… new landscaping for your outdoor spaces, interior remodelling, finishing the basement, building that shed you’ve always wanted.. the list goes on and on. Whatever your dream home renovation project is, let’s get started!

Advance Planning

The more you can plan in advance (like right now), the smoother your home renovation projects will go when the time comes to actually get the tools out.

One very important thing is to get your contractor and materials booked well in advance. Contractors, builders, landscapers, and trades are all very busy here in Muskoka (especially once spring arrives), so get yourself booked in with them if you decide to hire for your project. If you are doing the work yourself, awesome, make sure you block off some time in your busy work/life schedule to start and complete your project - there’s nothing worse then a half finished home reno.

A Little Goes A Long Way

Home renovation projects don’t have to be huge, sometimes the small things can make a big difference. Consider tasks like applying a fresh coat of paint inside or outside of your home, resurfacing/staining the deck, adding a new garden, or upgrading knobs and hardware.

In addition to being able to enjoy your new space once your project is complete, home renovations are always great for adding to the resale value of your home. A NEW YEAR is upon us, and confidence continues in the Canadian Real Estate Market, as growth is expected to remain strong in 2022.

National Trends

Even after experiencing record setting Real Estate numbers in 2021, it is projected that Sales will continue to rise in 2022, and the average Residential Sale Price will increase by 9.2%.

Despite the Global Pandemic, many Canadians feel confident in the Real Estate Market. According to a survey conducted on behalf of RE/MAX Canada, 49% of respondents believe Canadian Real Estate will remain one of their best investment options in 2022. “Canadians recognize the value and investment potential in their homes.” says Elton Ash, Executive Vice President, RE/MAX Canada.

Ontario Trends

Market activity across the province is anticipated to remain steady in 2022, with continued average price growth, anticipated average sale price increases and prolonged supply shortages.

Inter-provincial migration continues to be a key driver of housing activity in many regions in Ontario. The ‘relocation trend’ that began in the Summer of 2020 as the Pandemic set in, prompted Buyers to start looking for less-dense rural areas, greater affordability outside of big cities, and more overall space. This trend is likely to continue as many Businesses and Organizations have adapted to a work-from-home system for it’s workforce that is expected to remain in place into the coming year.

Muskoka Trends

The Number of Sales are expected to rise by 10% in 2022 and the Average Price is expected to increase 20% for the Muskoka region. This means that the Average Sale Price will increase to $749,357 in the coming year, compared to $624,464 in 2021.

Despite the growing value of homes in the Muskoka area some home owners might be hesitant to sell, choosing to take a "wait and see" approach during 2022. Creating a Calmness

As we inch closer and closer to the end of the year we are reminded of the year past, the good and the bad, and we reflect on ourselves, our own community and the world at large.

The thing we’ve been hearing a lot from people around us l ately is “This year just flew by, I can’t believe it’s already December!” And we can definitely relate to this on some level.

Most of us know the feeling well... as we fill our days with more and more busyness, time seems to fly by faster and faster. It’s no surprise really, given how fast our device-focused, multi-tasking lives can be on a day to day basis.

However, living through the pandemic this past year has taught us the need to slow down a little, because in some ways it forced us to. By slowing down, and creating a calmness in our lives it opens up the time and space to allow gratitude and joy to enter. Once we strip away the noise of everyday life, our perspective shifts and allows us to experience life in a whole new way. It allows us to better appreciate the events and people around us, rather than feeling like we're living our days in a blur. And it doesn't require a change of life, but rather a change of mind.

Dolf and I have been very mindful of this through the past year and have found ways to allow calmness to seep into our busy lives of work, family and personally. As we head into the holiday season, it’s the perfect opportunity to slow down, relax and simply enjoy the moment. Make the time to be present with loved ones, show gratitude, share love and give support to others, and in return you will feel a different kind of satisfaction than what a busy work day can bring.

As we slowly work our way back towards a whole new normal heading into 2022 and the light at the end of the tunnel shines a bit brighter everyday, we hope that the calmness and gratitude that we have reignited stands strong long into the future.

Dolf and I recently returned home from a week-long vacation to explore Canada’s East Coast. We cruised along the curvy coastline, took in the sights of the crystal blue ocean, ate some of the best seafood we’ve ever eaten and had an amazing experience. But one BIG thing that stood out to us during this trip, and something that you hear often about the East Coast, is how friendly and kind the people were to us and to each other. We were greeted with kind gestures everywhere we went, it seemed like it was woven into the culture and it made for such a pleasant and enjoyable experience for us.

This got us thinking about people, specifically about kindness and about how important it is in our individual lives as well as in our shared world.

The Cottage Country Boom

The overall Canadian real estate market was hot again in May and June, with sales activity up 256% year-over-year and prices gaining 2.4% from the previous month.

Even more shocking are the trends transpiring within the Ontario cottage country real estate market including Muskoka and Muskoka Lakes. During the pandemic, the number of people leaving major urban centres in favour of more rural communities has seriously changed the game. A blend of historically low interest rates, limited inventory and strengthening demand for homes in rural communities has put pressure on these markets.

So… you may be asking, what does the Ontario cottage country real estate market actually look like today in popular hotspots such as Kawartha Lakes or Muskoka? Here is a snapshot of the real estate activity unfolding in the Ontario cottage country markets, as reported by the CREA:

Why Is This Happening?

At first, it might be perplexing. Why would the broader Ontario real estate market be booming in an economic downturn, while tens of thousands are out of work?

The experts suggests a few of the main reasons are:

Families from large cities are using the massive profits from their houses or condos as leverage in bidding wars to prop up prices and secure the property in rural areas.
Record-low rates allows homebuyers to borrow more, giving them more purchasing power and more options.
The sudden influx of homebuyers flooding the market dried up housing stocks, and supply has yet to catch up.

We are all gearing up for summer, especially here in Muskoka - yearning for those lazy days on the dock, mid-afternoon dips in the lake, and most of all, looking forward to the mouth-watering flavours of summer!

For Dolf and I there are so many foods, drinks and family recipes that remind us of summer and we can’t wait to dig in, literally!

BBQ Grillmaster

There is one in every family, the self-appointed ‘grillmaster’ who can’t wait to whip out those tongs and fire up the Q.

The smokey smell of the barbecue can make any tummy grumble with hunger. When you think about grilling, you probably think about a big juicy steak or the perfect hamburger, which of course are great choices for any summer dinner. A High Demand Market

As realtors we have been getting a lot of questions about the current real estate market. Our answer… ‘It’s been interesting! ’ … and by that we mean it’s been interesting in many ways - with adapting to new and ever changing COVID-19 health and safety protocols, but also interesting in how the market quickly changed into a high-demand ‘battleground’ of sorts where buyers are moving quickly, competition is high, sales prices keep going up and things are happening at a fast pace.

We have seen this happening first hand throughout 2020 and now as we are looking into 2021, it does not not look like it will be changing anytime soon.

Muskoka Real Estate in Numbers

Through the RE/MAX Professionals North Brokerage February 2021 Market Report we can see that a Muskoka single family waterfront home sale price averaged $835K in February of last year, but rose over 90% to $1.58M in the month of February this year. Non-waterfront properties saw approximately a 60% increase with an average sale price of $626K.

Spirits High As Muskoka’s Real Estate Market Zooms Into 2021

There’s good news on the horizon for 2021 beyond the promise of the pandemic’s end. Real estate markets are thriving now, and key experts remain optimistic for the coming year. “Despite the tragic impacts of the pandemic,” says Elton Ash, a RE/MAX vice-president, “our optimism in the strength of Canada’s housing market has always remained.”

The Good News

Spirits are high, especially among sellers in Ontario, where average sale prices are expected to rise by more than 10% in 2021 depending on the region you’re in. The residential market outlook for the Muskoka region has estimated average residential sales prices rising by 13% in 2021. Properties that sold for $466,154 in 2020, for example, are forecasted to sell for $526,754 in the coming year. The province’s luxury markets are also thriving. Demand for high-end homes and cottages is enjoying a healthy spike—a trend that of course impacts those lakefront properties here in Muskoka. Plus, the average number of days on the market are expected to decline, which means, in many cases, buyers and sellers can anticipate multiple offers.

A Strong Seller’s Market

Two main forces are driving Muskoka into a 2021 Seller’s Market:

The influx of out-of-town home buyers
Access to high-speed Internet

There is zero doubt COVID-19 has heavily influenced Canada’s real estate buying and selling habits. “We’ve seen a lot of anecdotal evidence since the summer that households are considering significant lifestyle changes by relocating to less-dense cities and neighbourhoods,” says Christopher Alexander, a RE/MAX vice-president. “This has sparked unprecedented sales this year in suburban and rural parts of Canada and we expect this trend to continue in 2021."

Buyers On The Move

It seems that buyers who are interested in the Muskoka region are in search of more space. RE/MAX surveys reveal that in the wake of the pandemic, homebuyers are seeking more square footage as well as more green space outside. Driving factors also include a rise in remote work (the ability to work from home), the implementation of better, stronger internet services in small towns, a desire for more space and less density, as well as lower housing prices offered outside major cities.

“Canadians are on the move,” states a recent company-wide study. “RE/MAX isn’t calling this an ‘exodus’, but the re-location trend across the Canadian housing market is real.” The report also predicts that the ongoing and widespread housing supply shortage is likely to continue, presenting challenges for homebuyers and putting upward pressure on prices.

Spotlight: Muskoka

How does all of this play out in Muskoka? Here’s a summary of forces affecting our local real estate market:

Muskoka saw an average waterfront price of $1.2M in 2020 - up 24% from 2019, while our non-waterfront average sales price increased by 20% to $475K.
The housing supply across the district is currently a challenge.
Top neighbourhoods continue to be Huntsville, Bracebridge and Gravenhurst—the largest towns in the district.
Typi cal first-time buyers here are seeking single-detached homes within a price range of $300,000 - $400,000.
New construction developments here are uncertain as they face delays due to cost increases in materials and shortages in labour.
Luxury buyers that come from larger Ontario cities and will spend more than $2 million per property.

Optimism Continues

Overall, while the pandemic continues to unsettle Canadians, experts remain optimistic regarding its impact on the national real estate market. Many agree it comes down to a want and need for more space, especially among younger demographics who have the ability to work from home. “Younger Canadians under age 35,” says a recent report, “are significantly more likely to have realized that they need more space and are motivated to move out of their current neighbourhood.”

2020 - An Unforgettable Year

Well, hello there end-of 2020! You certainly were one for the record books.

As a New Year draws near and Dolf and I reflect on the past 12 months, we are amazed and proud by the ways in which our community came together in a tough time. Living here in Muskoka has many privileges, not the least of which is the way we’re able to depend on our community and our neighbours in times of challenge. The pandemic has taken so much from us, but it has also helped us unite . There are so many ways we’ve assisted one other, from wearing masks and staying home when required, to shopping and eating local. It all pays dividends in keeping Muskoka safe, strong and thriving.

When it comes to the Business of Real Estate , we are encouraged by recent reports from the Canadian Real Estate Association(CREA) that National home sales have continued at historically strong levels. “For anyone waiting for the Canadian existing home market to begin to settle down following this summer’s surprisingly strong recovery,” says Shaun Cathcart, CREA’s senior economist, “they’re going to have to wait a little longer. It was evident that the same trends we’ve been seeing since July—record sales and record prices amid tight overall supply—was once again the story in October and November and now into December.”

Dolf and I continue to receive Requests and Referrals for people seeking all types of Real Estate Muskoka wide. Ranging from Luxury waterfront to Family homes and all between there is much demand and lesser inventory. Influencing factors that help to elevate the prices and demand are evident, along with technology and internet capabilities improving ability for working from Home.

When it comes to safety protocols, Realtors continue to exercise precaution . Safety protocols include relying on digital signature providers such as DocuSign to reduce the exchange of paperwork, stringent cleaning, the wearing of face coverings, and conducting virtual showings when possible to minimize risk.

Happy Thanksgiving, Muskoka

Turkey, squash, pumpkin pies peppered with ginger, nutmeg, and ground cinnamon. October is a time for indulging in the best of the harvest, yes! But it’s also time for giving thanks. Dolf and I have so much to be thankful for this fall: our family, our friends, our health, and of course you, our clients, who make loving life in Muskoka an absolute pleasure.

Muskoka Thanksgivings

We’ve been in Real Estate in Muskoka since 1992, and through those 28 years we’ve seen Cottage Country thrive and grow. A little digging reveals that Thanksgiving traditions go back a long way in lake country. The District of Muskoka lies within the traditional territory of the Anishinaabeg (Ojibwe), and is named after an Ojibwe chief titled Misquuckkey, or Mesqua Ukie.

It is tradition among indigenous peoples of North America to hold Communal feasts in autumn to celebrate fall harvests. European Americans introduced “Thanksgiving” celebrations to Nova Scotia Loyalists in the 1760s not only to mark their appreciation for the harvested cornucopia, but also to give thanks for the end of the Seven Yea rs’ War. Obviously the tradition stuck!

Fast forward to 2020 and Canadians are still giving thanks for good food and good friends, and perhaps for staying safe in a time of turmoil caused by politics and pandemics.

Things to Consider When Purchasing a Waterfront Property in Muskoka

Close your eyes and picture this… the warm sun on your face, a cool breeze gently blowing around you, and the only sound in the background is the trickle of water hitting the shoreline.

Now, doesn’t that sound like paradise? Welcome to life in Muskoka... pure paradise.

Little in life can match the tranquility and peace of being on the water—but when it comes to purchasing your own piece of heaven in a Muskoka waterfront property, there is a unique set of considerations to keep in mind.

The Lake

Before you even look at the cottage itself, consider the lake and the area you want to be in. In Muskoka and the Muskoka Lakes there are a lot of properties and many lakes to choose from.

The size of the lake matters, we can help to determine what lakes will suit your needs. If you like to go boating, tubing, and water-skiing you will want to be on a larger lake that is better suited to this type of high speed activity. Or if fishing, canoeing and a peaceful ride on a SUP are more your pace, you may want to consider a smaller lake.

With so many different types of lakes and rivers in the Muskoka area, a local Realtor is always your best option to guide you to the perfect waterfront location for your needs.

The Waterfront

Muskoka has a wide variety of landscapes and topography, and when it comes to lakefront you will see it can be deep, shallow, rocky, sandy, lush or in most cases a combination of all of these.

If you have young children in the family, a shallow or sandy area at the water is always preferable. However if you have a motor boat you should consider where the boat will be docked and if the depth of the water will be suitable.

Speaking of docking a boat… another thing to consider is the dock! Is there an existing dock and does it fit your needs. If not, you’ll need your local Realtor to review with you the guidelines from the local Municipality and Ministry of Natural Resources to ensure that you can put in a new dock with the restrictions and bylaws that are in place for your specific location.

Another important but often overlooked factor for waterfront cottages and homes is the exposure - the direction the cottage faces. Generally, cottages with South West exposure are the most sought after because they tend to have all day sun and sunsets in view over the lake.

You want your waterfront area to be your ‘happy place’ so it is important to ensure that everything is perfect before making the big decision to buy.

Boating & Cottaging in the Age of COVID-19

When it comes to cottage country and COVID-19, you may be asking yourself questions like;

Can mosquitos transmit the virus?

What are the rules on the water, beaches, marinas?

Where in Muskoka are masks mandatory?

If you’re curious about how to enjoy your summer on the water boating, beaching, and exploring while still upholding the proper health and safety precautions during this pandemic, read on for answers to some of the most frequently asked questions.

Those Pesky Insects

It’s true, social distancing isn’t a thing if you’re a mosquito.

These noisy, pesky bugs are out in force; apparently they didn’t get the W.H.O.’s #stayathome message. Still, according to the pros, boaters and cottagers don’t have to worry. “Members of the coronavirus family (SARS-CoV, MERS-CoV, SARS-CoV-2) are not transmitted by insects,” Jason Kindrachuk told Cottage Life recently. He’s an Assistant Professor and Canada Research Chair in emerging viruses at the University of Manitoba—where, incidentally, there’s no shortage of mosquitoes. So, while we don’t have to love or even like mosquitoes and black flies, as cottagers and boaters we don’t have to fear them, either.

Just remember to grab the bug spray!

Life On The Water

Boating in Ontario has surged during the pandemic, especially as the weather started heating up in May and June. What a great way to physically distance - anchored in a sheltered bay fishing or exploring the coastline of the many lakes and rivers in Muskoka. New and used boat sales are also experiencing an uptick, with new boaters keen to get on the water.

Dolf and I love to see new boaters and young families getting out on the lake and experiencing the joy and excitement of boating. Our family grew up on the lake, in the boat, swimming and water skiing, it has always been a big part of our summers and a great way to spend quality time with family. Even though she’s only two our granddaughter Olive loves every minute on the water!

How to Social Distance: Boats, Locks, Beaches & Marinas

Marinas, beaches, and locks in Muskoka have been open since the May long weekend. Boat rentals, fuel, groceries, gifts, lifts… all of it is now available at marinas and lakeside facilities for the summer. But there are protocols and best practices boaters need to follow that differ from past summers. Boating Ontario has released a list of best practices while boating. They include:

Only boat with those in your immediate household or Social Circle.
Pre-arrange fuelling, and maintain distance from others at fuel/service docks.
Keep your distance on the water, no rafting.
Don’t beach, moor or dock your boat too close to another boat.

And while locks, beaches, and marinas are open across the Muskoka District, boaters should note that docks and handles are not sanitized, and you should use at your own risk. It is also important to know that at most marinas staff are accepting cashless payments only and visitors are being asked to practice physical distancing and respect all onsite signage.

Stage 2 Protocols in Effect for Muskoka

Finally, Muskoka health officials continue to remind cottagers and boaters of Stage 2 protocols while visiting Muskoka. We remind you to please continue to:

Maintain physical distancing of at least two metres from anyone not in your household or your Social Circle,
Wash your hands frequently and thoroughly,
Wear a mask in settings where you can not maintain distance such as public areas or stores,
Cough or sneeze into a tissue or into your sleeve, and
Monitor your health for symptoms and please stay home if you feel ill.

Riding Muskoka’s Real Estate wave during COVID-19 has been a bit like learning to wakesurf— it’s all about finding your balance. Dolf and I are hanging in there. In fact, we’re up for the challenge. But there’s no doubt the Muskoka market is changing and will change again—perhaps many times—before this global pandemic is over.

Best Practices

Best practices for Buying and Selling houses and cottages have been top-of-mind for all Royal LePage agents. We’ve been moving quickly to adapt. Brokerage and Real Estate Services are deemed “essential” by the Ontario Government, but we’re learning new guidelines daily to flatten the curve and stop community spread. We’re dedicated to everyone’s safety.

As Realtors, how are we finding the right balance?

Extraordinary Times, Extraordinary Measures

In-person showings are still happening and, as a result, new and extraordinary measures have been adopted to mitigate spread and enhance safety. For example, strict protocols are in place, including hand-sanitizing, distancing, health screening, restrictions on the number of people in a home at one time, and a limit to the number of showings in a 24-hour period. Dolf and I are adhering to these protocols; we’re keen to run through all of these practices with you if you are thinking about Buying or Selling this spring or summer.

Impacts on the Market

As a Buyer or Seller, you may be asking yourself: What’s the state of the Canadian Real Estate Market? Dolf and I have been tracking the situation closely.

Before the World Health Organization (WHO) declared a pandemic on March 11, the spring real estate market was set for a record-breaking sales season. According to the Canadian Real Estate Association, the month of February was particularly hot for year-over-year sales, which rose 27% across Canada. Low supply and high demand drove up prices. By all accounts, it was a tight Sellers’ market.

In Muskoka this trend proved true here as well, January started 2020 off with high activity in residential sales compared to the past few years. Despite this strong start, market activity in March and April has slowed due to COVID-19. Buyers and Sellers both are reluctant to jump in, and it’ll take time for the waters to calm down again.

But let’s remember: There are Buyers and Sellers out there who are highly motivated. The reality is that some people need to relocate for work, or they’re looking to downsize or upsize quickly. There is a need and demand for all types of properties throughout Muskoka. Even though real estate market activity is down, it's not plummeting, and we feel like a rebound is on the horizon.

And now it's feel like we are nearing the end of the tunnel, a glimpse of light is shinning through, with government restrictions slowly being lifted and businesses planning for re-opening.

So stay tuned as we head (opportunistically) into June. Dolf and I are keeping a close eye on the evolving situation. In the meantime, maybe we’ll perfect our wakesurfing—we’re getting good at finding our balance.

We have very quickly found ourselves living in an unfamiliar and drastically transformed world. We are facing an unprecedented time in our history and extraordinary circumstances that affect every single person worldwide.

More than ever, the statement rings true; think globally, act locally . We believe that every person can make a larger impact when they consider the health of the entire planet and take action in their own communities.

During this challenging and quickly evolving situation we are so proud to see the acts of kindness and support emanating from the Muskoka area. Positivity is spreading throughout our communities and helping to extinguish negativity and fear. Let’s continue to support each other and keep sharing those positive stories, we are in it together!

With the health and wellbeing for ourselves and our community as the number one priority, we have been self-isolating in our home in Port Sydney. We always try to make the best of every situation, this has been no different. We have been enjoying nature walks in the peaceful forests around us, spending quality time with one another making dinners and watching movies and we even dug out the Nintendo Wii and having some friendly competitions (that Anzie is winning).

We have also found that this ‘forced down time’ has been a great opportunity to work on future plans for our business and there will be some exciting news on that coming soon!

Well… March is upon us which means Spring is right around the corner, but there is still plenty of time to have some winter fun. Whether you are looking to overcome the winter blahs or wanting to take advantage of March Break activities with your kids, there is something here for everyone.

We have lived in Muskoka for 30+ years and we fully embrace every season. We want to share the inside scoop with you about the very best winter activities and attractions that you simply cannot miss this year. It wasn’t easy but we narrowed it down to our top 3 favourite things to do in the winter in Muskoka , here we go!

Arrowhead Provincial Park in Huntsville hosts many fun outdoor activities all year long, but we think that it is the absolute best in the wintertime. Arrowhead is best known for its 1.3 km ice skating trail which leads skaters through the beautiful snow covered forest. This unique attraction brings in thousands of visitors every year from far and wide, it is something you definitely need to experience with the whole family.

Arrowhead also has amazing cross-country skiing and snowshoeing trails, all fully groomed and maintained. Snowshoeing is perfect if you are looking for a more leisurely winter experience.

Insider Tip:

If you don't have your own equipment but still want to join in on the winter fun you can rent equipment at the park. Skates, snowshoes and ski rentals can be rented for a fee at Arrowhead's newly built visitors centre.

The Muskoka Maple Trail this year starts on March 13th and runs until April 24th. We honestly can't wait for this one since we love the delectable taste of local maple syrup, it’s a staple in our house!

The Muskoka Maple Trail is a large event that happens throughout Muskoka and includes sugarbush tours, pancake breakfasts, special maple inspired culinary offerings and more. Popular eateries such as Deerhurst Resort, The Pasta Shoppe, and Whimsical Bakery will all be serving featured menu items made with maple syrup. Local breweries and wineries such as Lake of Bays Brewing, Sawdust City Brewing, and Muskoka Lakes Winery will also be crafting their own maple infused beverages.

Do you know how maple syrup is made? It is a very interesting process and takes a lot of work to produce top quality maple syrup. We highly recommend checking out the various sugarbush tours around Muskoka to see first hand how maple syrup goes from a tree in the woods to sweet syrup on your plate. Sugarbush Hill Maple Farm and Maple Bluff Farm located in Huntsville, and Sweetwater Maple Syrup located in Bracebridge will be offering fun and educational experiences for the whole family.

If you are looking for a more thrilling winter activity, the hills at Hidden Valley Highlands and Ski Area offer some real adventure and excitement. Our family grew up skiing at Hidden Valley and spent many days enjoying the winter season on those hills. The great thing about Hidden Valley is there are hills ideal for beginners as well as advanced slopes for the more experienced skiers and snowboarders.

Every year we make sure to get out on the slopes, and this year will be extra special as we will be introducing our adventurous granddaughter to the sport. We couldn’t be more excited to pass along this family tradition!

If your kids are curious about getting into skiing or want to gain more experience, Hidden Valley is hosting 3-day March Break training camps for kids aged 3 to 14 years old.

Fun fact!

Dolf worked as a Ski Patroller at Hidden Valley for over 20 years and our children even worked there too. So we truly know those hills like the back of our hand, and we still love going back year after year!

New Real Estate Rules & How They Affect You

We all know that things are constantly shifting in Real Estate. After 28+ years in the industry we have seen and experienced our fair share of changes to Real Estate Policies and Regulations.

Change is inevitable, but knowing how these changes affect you as a home owner, a renter, a buyer or a seller can be the more difficult part. That is where we come in… we are here to help you navigate your way through these changes.

The Ontario government recently introduced Bill 145: Trust in Real Estate Services Act which includes broad changes that will affect the entire Real Estate Industry. This Act will implement new policies to continue and strengthen consumer protection. Good news for you!

Clarity is key! We believe that all consumers deserve to work with a Real Estate Representative that takes the time to explain, educate and support you through the buying and selling process. We are thrilled that the Ontario Government is in the process of implementing these changes province wide to provide consumers more protection.

The most important changes of this new legislation are:

Adding clarity for Buyers and Sellers so that they know whether they are represented by a brokerage, or if they are self represented;  
Requiring new disclosures to Buyers and Sellers to support informed decisions;  
Additional regulatory powers that will provide RECO with more tools to remove the worst offenders from the real estate industry; and  
Making it easier for RECO to levy fines against real estate salespeople for certain violations of the legislation.

1. If you are running out of space.

We always suggest that when purchasing a new home, you should think 5 - 10 years into the future. It may be hard to do but considering things like; the possibility of a new baby, friends and family members frequently visiting, the potential for an in-law or grandparent moving in.

2. If it's a hot Real Estate market.

If you are noticing Sold signs on lawns and home prices are rising in your neighbourhood, it might be worth talking to a Real Estate Professional. Home Inspections

Buying a home may well be the largest financial investment you will ever make. Naturally you will want to know as much as possible about the property before you finalize the purchase at closing.

It's important to hire a knowledgeable, independent home inspector for advice on the overall condition of the property. The purchase contract usually requires specific time periods for each inspection, and it's critical that these time frames be met. Usually the cost for any and all inspections and re-inspections are paid by the Buyer. Prices can range from $350 to $500 for whole-house inspections.

Some examples of common inspections are:

Structural - Defects caused by poor construction, soil movement, water or drainage conditions, settlement, fire, etc.

Environmental Hazards - Including asbestos, lead-based paint, radon gas or any other toxic material.

Roof - Can include framing members, decking and shingle condition.

EMP Electrical, Mechanical and Plumbing - Should include electrical and plumbing systems, built-in appliances, heating and cooling systems, swimming pool/spas, sprinkler systems and security systems.

Septic and Wood Burning Systems - Ask if your inspector is licensed to conduct septic and WETT inspections.

Many companies specialize in only one area of inspection and others will group several together and offer a package price. Whichever route you go, assure yourself you're getting the inspections you need. Ask us and we can provide a list of our local trusted partner companies to choose from.

Agents - Who's Working For You?

In real estate, there are different forms of agency relationships. Before an agency is established in writing, an agency relationship may be established by the actions of the individual parties. If it walks like a duck and talks like a duck it might be legally defined as a duck, but usually, any relationship before a signed agreement is more likely to be classed a “customer relationship.”

A customer relationship is generally defined as the agent owing a duty of honesty and reasonable performance, but is not under contract to perform as an agent. All agency agreements define the specific performance required of the agent, how the agent is to be compensated for that performance and the responsibilities of all parties.

The different kinds of written agency that are available are:

1. Seller's Agent

When a real estate company is a “seller's agent,” it must do what is best for the seller of a property. A written contract, called a listing agreement, establishes seller agency. It also explains services the company will provide, establishes a fee arrangement for the REALTOR®'s services and specifies what obligations a seller may have. A seller that enters into a non MLS® Exclusive Listing Agreement has great flexibility in the terms and conditions of the contract. A seller entering into a MLS® Listing Agreement has somewhat more limited flexibility being required to conform to the standardized rules and regulations of the MLS® system. A seller's agent must tell the seller anything known about a buyer. For instance, if a seller's agent knows a buyer is willing to offer more for a property, that information must be shared with the seller. Confidences a seller shares with a seller's agent must be kept confidential from potential buyers and others.

Although confidential information about the seller cannot be discussed, a buyer working with a seller's agent can expect fair and honest service from the seller's agent and disclosure of pertinent information about the property.

2. Buyer's Agent

A real estate company acting as a "buyer's agent" must do what is best for the buyer. A written contract, called a Buyer Agency Agreement, establishes buyer agency. It explains services the company will provide, establishes a fee arrangement for the REALTOR®'s services and specifies what obligations a buyer may have. Typically, buyers will be obliged to work exclusively with that company for a period of time.

The buyer agency contract is a contract between an agent and a client and is usually based on the Ontario Real Estate Association’s Buyer Agency Agreement. This contract can be modified by written agreement of both parties to their satisfaction. There are no MLS® requirements for buyer contracts as there is no Buyer MLS® system in place at this time. Confidences a buyer shares with the buyer's agent must be kept confidential.

Although confidential information about the buyer cannot be disclosed, a seller working with a buyer's agent can expect to be treated fairly and honestly.

3. Dual Agent

Occasionally a real estate company will be the agent of both the buyer and the seller. The buyer and seller must consent to this arrangement in their Listing and Buyer Agency Agreements. Under this “dual agency” arrangement, the company must do what is best for both the buyer and the seller. Since the company's loyalty is divided between the buyer and the seller who have conflicting interests, it is absolutely essential that a dual agency relationship be established in a written Agency Agreement. This agreement specifically describes the rights and duties of everyone involved and any limitations to those rights and duties.

Current legislation in Ontario deems all sales representatives and associate brokers working for one brokerage company, no matter how small or large, to be the same agency. This automatically puts all buyers under contract with any representative from that company, who are interested in any of that companies’ listings, in a Dual Agency situation for those listings.

Who's working for you?

It is important that you understand who the REALTOR® is working for. For example, both the seller and the buyer may have their own agent which means they each have a REALTOR® who is working for them.

Or, some buyers choose to contact the seller's agent directly. Under this arrangement the REALTOR® is working for the seller, and must do what is best for the seller, but still may provide valuable services to the buyer.

If the seller and the buyer have the same agent, this is dual agency and the REALTOR® is working for both the seller and the buyer.

A REALTOR® working with a buyer may even be a "sub-agent" of the seller. Under sub-agency, both the listing agent and the co-operating agent must do what is best for the seller even though the sub-agent may provide many valuable services to the buyer.

Sub agency is created when a buyer chooses not to make a contract with a buyer’s agent and indicates in writing that they would prefer the agent they are dealing with to be the agent of the vendor and for them (the buyer) to have "customer status" only with the agent they are dealing with.

Code of Ethics

REALTORS® believe it is important that the people they work with understand their agency relationship. That's why agency disclosure is included in a self-imposed Code of Ethics which is administered by the Real Estate Council of Ontario. The Code requires REALTORS® to disclose in writing the nature of the services they are providing, and encourages REALTORS® to obtain written acknowledgement of that disclosure. The Code also requires REALTORS® to enter into a written agency agreement with any sellers or buyers they are representing.

REALTORS® are governed by the legal concept of "agency." An agent is legally obligated to look after the best interests of the person he or she is working for. The agent must be loyal to that person. A real estate company may be your agent – if you have clearly established an agency relationship with that REALTOR®. But often, you may assume such an obligation exists when it does not. REALTORS® believe it is important that the people they work with understand when an agency relationship exists and when it does not -- and understand what it means.

What is title insurance?

Title insurance is a form of insurance in favor of an owner, lessee, mortgage or other holder of an estate lien, or other interest in real property. It indemnifies against loss up to the face amount of the policy, suffered by reason of title being vested otherwise than as stated, or because of defects in the title, liens and encumbrances not set forth or otherwise specifically excluded in the policy, whether or not in the public land records, and other matters included within the policy form, such as lack of access to the property, loss due to unmarketability of title, etc. The title policy form sets forth the specific risks insured against. Additional coverage of related risks may also be added by endorsements to the policy or by the inclusion of additional affirmation insurance to modify or supersede the impact of certain exceptions, exclusions or printed policy "conditions." The policy also protects the insured for liability on various warranties of title.

In addition, the policy provides protection in an unlimited amount against costs and expenses incurred in defending the insured estate or interest.

Before it issues a title policy, the title insurance company performs, or has performed for it, an extensive search, examination and interpretation of the legal effect of all relevant public records to determine the existence of possible rights, claims, liens or encumbrance that affect the property.

However, even the most comprehensive title examination, made by the most highly skilled attorney or lay expert, can not protect against all title defects and claims. These are commonly referred to as the "hidden risks." The most common examples of these hidden risks are fraud, forgery, alteration of documents, impersonation, secret marital status, incapacity of parties (whether they be individuals, corporations, trusts or any other type), and inadequate or lack of powers of REALTORS® or fiduciaries. Some other hidden risks include various laws and regulations that create or permit interests, claims and liens without requiring that they first be filed or recorded in some form so that the potential buyers and lenders can find them before parting with their money.

Since the cost for home owner's title insurance is usually sharply reduced when taken simultaneously with the issuance of a purchase money mortgage, the risk is one that a well informed buyer should not take. In fact, several states have adopted statutory requirements which require a notice to home buyers as to the availability of title insurance similar to that being obtained by their purchase money mortgages.
